DRUMHELLER, Alta. - A fatality inquiry report on the accidental drug overdose of an inmate in an Alberta prison says the war on drugs cannot be won.

The grim assessment from Judge Les Grieve follows a probe into the death of Kory Stewart Mountain at the Drumheller penitentiary in December 2008.

Inquiry Judge Les Grieve says there was nothing staff at the prison could have done to prevent the death of the 40-year-old man, who was serving time for selling drugs.

Grieve noted in his report released Tuesday that Mountain had little support while he was growing up and that he was abused by his father -- a drug trafficker who was murdered.

The judge says society does not seem committed to the battle against drugs as seen by celebrity and sports stars who abuse drugs, but are still revered.

He says it may be that all that can be hoped for is to keep the casualties of the war to a minimum.
