PHILADELPHIA - The former Pennsylvania prosecutor who declined to charge Bill Cosby in 2005 wants access to the case file to defend the accuser's defamation lawsuit.
But the current prosecutor says Bruce Castor is no longer entitled to the investigative files.
Montgomery County District Attorney Kevin Steele is fighting Castor's subpoena for police statements and other documents.
Accuser Andrea Constand has sued Castor for defamation over his comments that she changed her story about her 2004 encounter with Cosby.
Steele reopened the case last year and charged Cosby with sexual assault.
Castor insists he had promised that Cosby would never be charged in the case.
